No Jail Time for Pedophile who Plead Guilty to Sexually Assaulting Minor

A man from Virginia who sexually assaulted a 14-year-old girl will walk free after originally being sentenced to 10 years in prison, with 8 years suspended.

Chesterfield Circuit Judge T.J. Hauler permitted convicted pedophile Logan Michael Osborn’s sentence to be suspended rather than to put him behind bars.

Osborn plead guilty in September to the charge of having carnal knowledge of the teenage girl, telling the court he took responsibility for his “poor judgement,” as Richmond Times-Dispatch reported. Osborn agreed to a plea deal in which he would plead guilty as long as prosecutors wouldn’t pursue a forcible sodomy indictment against him.

As reported by the Daily Mail, prosecutors say Osborn met the girl at a high school play in April of 2017 and the two took a walk together after the performance. He reportedly led her away from everyone, tied a belt around her neck and hands, pushing her onto her knees and against a fence, then proceeded to sexually assault the 14-year-old victim.

The age of consent is 18 in Virginia.

This is not the first time Osborn has been accused of inappropriate sexual conduct with girls.

“One of those prior incidents resulted in Osborn being charged in 2011, at age 12, with grabbing the genitals of another student. The case was taken under advisement by the court and eventually dismissed,” according to the Richmond Times-Dispatch.

Judge Hauler is no stranger to controversy for light sentencing for violent and sexual crimes.

In 2016, Hauler was heavily scrutinized when he rejected the state of Virginia’s request to deny the release of Dana William, who had been imprisoned for the rape of his ex-girlfriend, WTVR-TV reported.  After William was released he strangled to death his ex-wife’s father and abducted her mother in January 2016. As police were moving in to arrest William, he fatally shot himself and investigators later located the body of the mother on the side of the road.

Virginia state Sen. Steven Martin criticized Hauler in 2009 for having so many decisions overturned, WTVR reported.

“I had serious concerns and did some research and felt like it was best that he not continue on the bench,” Martin said.

The 14-year-old victim’s family said they were “disappointed that the defendant will not serve any active incarceration for the brutal attack,” according to prosecutor Erin Barr. “They do not believe justice has been served and share concern for community safety and future potential victims.”

Osborn’s scholarship to the University of Mary Washington was revoked post conviction and he is required to register as a sex offender.
