New York Times Passes Off Old Stock RBG Photo As Image of ‘Return to SCOTUS’
In The New York Times’ article reporting on Supreme Court Justice Ruth Bader-Ginsburg’s return to work at the court, the paper used a stock photo of Ginsburg taken last November rather than a recent photo.
The Times reported on Ginsburg’s return to the court without any recent visual aids to expand upon her return, after she missed over a month of hearings after medical scans taken after a fall last year led to an emergency surgery to remove cancerous nodules from her lungs.
Instead, the Times used a photo dating from last November. While the photo is several months old, the New York Times did not date the photo, leading some readers to believe it was current.
Social media users uncovered the possibly deceptive use of the image, with independent content creator Jordan Sather posting to social media that the photo “was actually taken last November,” and noting that he has “still seen no current photo.”
The photograph of RBG that the New York Times used in their report yesterday about RBG returning to the Supreme Court was actually taken last November.

Earlier this month, it was also reported that Ginsburg made her first public appearance at a concert held at the National Constitution Center. However, there again were no photos taken of Ginsburg.
The justice sat in the back of the darkened auditorium at the National Museum of Women in the Arts.
The National Constitution Center, which sponsored the concert, did not permit photography.
James Ginsburg said before the concert that his mother is walking a mile a day and meeting with her personal trainer twice a week.
The performance concluded with a song set to Ginsburg’s answers to questions.
In introducing the last song, Michaels said, “bring our show to a close, but not the epic and notorious story of RBG.”
The last known public sighting of Ginsburg that contained photographic evidence was on January 9, 2019, when she was wheeled from her Washington, D.C. home into a limo. Her reason for leaving her home so soon after her cancer surgery is still unknown.
